Why HOAs and Paxton Towing suck.
I shouldn't have waited to post this entry, but I was too pissed to think about this blog during the incident where Paxton Towing, a fuck'n lame ass towing company, stole my vehicle. On the 19th I drove down to San Diego to spend the weekend with my family and a family friend's son. I left Los Angeles noonish to avoid the traffic. I made great time and arrived about 3ish, and low and behold there was a parking spot on the street with a close proximaty to my parents house. The spot did not read guest or reserved. It's the perfect spot.
However, this perfect spot turned the following day into one of the worst days ever. In the middle of the night those fuckers, Paxton Towing, stole my car from the perfect non-guest, non-reserved spot. They claim it was parked in a guest spot, and that unlabeled spots, such as the one I was parked in, was guest.
I don't know about laws in other states, but in California, for some reason HOAs can give rights to tow truck drivers to enforce laws, even when they have no training and no legal right to do so. In all other cases a police officer needs to give the order to tow a vehicle. Those crooked fuckers have a racket going. They stole my car and demanded a ransom to get it out of the impound. They're nothing but common thieves.
Now I'm stuck sending a letter to the HOA demanding a refund, if no refund then I get to enter arbitration. And, if still no refund, I get to take the HOA and Paxton Towing to small claims. Usually, these fuckers get away with their racket because legal fees cost more than the impound fee. But these fucks messed with the wrong person. I have the priviledge of working for a great lawyer and I get all the legal advice I need. The HOA and Paxton Towing can go fuck themselves.

An SIA investigation uncovered a dirty little secret about the law, and how it works against you if you've had your car towed. Residents of the Timbers apartment complex were finding that their cars were disappearing within minutes of their walking away.
"It's a scam and they're making a lot of money," said Kevin LaChapelle, Director of SIA (Formerly Center for Integrity and Ethics). The law says a towing company cannot simply cruise around looking for cars to tow. A way to get around that is to have another company do the looking, contacting the towing company when a violation is found. SIA found that a towing company called Paxton Towing, is being notified of parking violators by a company called All Southland Parking Management. Both companies are owned by the same man, Bo Lemler. Lemler says his lawyers have told him that it's perfectly legal. SIA found that (towing companies) have been targeting low income housing and apartment complexes. According to Deputy Attorney General Al Sheldon, "The code does seem to say that the person who either owns the property or is in control of it needs to be physically present at the time of towing." The San Diego District Attorney's Office has set up a tow truck complaint hotline. The phone number is (619) 515-8608.
I truly truly hope you get something out of them. I know that it can get really expensive to have your car impounded. As far as the so called parking management company called "All Southland Parking Management" Yes it is owned by the same company. I know this for a fact. I used to work for them.
Before anyone starts saying I'm a thief and blah blah blah, I've been around towing my whole life. Family owns a tow company. We do AAA, Road America, Geico, roadside company's. You know the people who come out when you get a flat, we come change it for you. You know, the tow tuck you're happy to see. When I moved to San Diego, I needed a job quick. I never let my kids want for anything. So I took what I could get and dealt with it. That is until I got fired for being the only person there without a criminal or prison record. Funny that I'm the one they didn't trust huh.
There is a ton of loop holes in these laws. But the easiest one is make them prove that the person who signed for your car to be towed was present from when the tow truck arrived to pick up our car until your car left the property with the tow truck. Also, check and see how many other cars were towed that day out of that complex or any of the surrounding ones. If you could tell me the property name I might be able to help morel
P.S. It's not the driver of the truck to blame. Remember, He or She has bills and kids and family to and needs a job. Sometimes you have to take what you can get. But when every time you get to meet the owner of the vehicle they're threatening to kill you or have something painful looking in there hands, you tend to not have the best attitude. The absolute best way to deal with a tow operator is to do so calmly and with a smile, you might get your car back or free. With me, If you started cursing at me before either you or I have said hi chances are I was taking your car with me. And for the people who took a swing at me, well.......Evey one knows you should never pick a fight with a Marine. Well you should never get in a fight with a tow truck operator anyways. All that will happen is you will go to jail, and he's still gonna take your car and this time it will be with the local law enforcements blessing, and possibly with a 30 day hold on it.
All this really comes down to is that a few bad apples who we shall leave nameless ( LMAO ) have given everyone a horrible reputation. I do believe that some people do deserve to be towed, especially the ones who park in the handicap spot because they're to lazy to walk the extra 50 feet. but there needs to be a better way to deal with the rest.

By the way. I should have a few people from paxton towing calling any minute with some fine words of encouragement for my excellent narrative skills. :P
They just did the same to me, I have to paid for my car impounded in my own parking lot. When I went to pick my car I saw one of the drivers trying to open with a stick a car that was towed. When He saw me he moved away to his truck. They told me that they don't open the cars, but it seem that somebody is lying, because it was clear was the driver was doing.
If anyone needs help recovering what they paid Paxton Towing drop me a line fireandflood@juno.com and I will provide the infor you need to sue in small claims and win. I was towed and paid $315 to retrieve my vehicle. I was awarded a judgment of over $1200 against the tow company.
